Acceptable Use Policy
SkyeNet
has an AUP (Acceptable Use Policy) to protect our networks, servers, ability to
run fast, highly available networks with little interruption. Violation(s) of
any of these terms could result in termination of your account without refund,
from SkyeNet, any terminations fees, deposits or any other moneys put towards
your account are immediately forfeited. We also may take legal action to collect
any damages caused by any type of misuse of any of our networks, equipment,
services, or anything SkyeNet owns or operates.
Warranties/Disclaimers:
Anyone who uses any SkyeNet or associated service, is doing so "as is", with no
guarantees, no warranty of any kind. SkyeNet, or any affiliated services,
employees, owners, or associated anything with SkyeNet has any intention of
being financially liable to any customer for any harm that may occur through
their use of our services, regardless of whose fault it might be. Total
economic obligation, if any and at our discretion, will not exceed that of 1
month of service.
Security/Privacy:
We encourage our customers to use strong passwords, however, they do get to
choose their own passwords which may not be secure. SkyeNet implements its own
security software, hardware, and other systems but does not hold any
responsibility for any problems related to security be it anyones fault. SkyeNet
does keep confidential information as secure as possible; however the customer
has no enforceable right to total privacy from a data packet standpoint. SkyeNet
will make all possible attempts to make sure that your privacy is kept secure.
We do not give out log files, customer information, browsing history, or any
other private information and may challenge court orders and subpoenas to do so
(but do not guarantee we will win, and we do not make any guarantees we will not
hand over records if legal requests are made). We keep all personal data on an
un-connected network of servers (not connected to the internet) and go through
many measures to ensure privacy. We make no guarantees but will give our best
effort to protect your privacy we believe so highly in.
Personal
Files:
SkyeNet, nor any of its affiliated equipment, services, or personnel, are
responsible for any subscriber files including web space, domains, entire web
sites, personal data, or any files at all. We are not obligated to keep this
information. However, SkyeNet does implement a backup system which may or may
not include your files. SkyeNet recommends you backup your web sites and other
data as SkyeNet is not responsible for this. If you are no longer a customer, at
our determination or yours, we can/will delete all of your files at any time.
SkyeNet does maintain a responsible backup system and hope to prevent loss of
data in the future but we are not obligated to do so.
Nontransferability of Account:
Customers may not re-use, move equipment, or in any way share the services.
Passwords and usernames are to be kept private. Web space is to be kept secure.
Any sharing of the account, at SkyeNet’s discretion, can result in termination
of the account. Without written agreements no person or company may re-sell
SkyeNet services.
Network
Address Ownership:
Any IP addresses assigned to you are considered loaned to you, and not given.
They will revert back to the SkyeNet, after the customer the DHCP lease expires
or when SkyeNet or the customer terminates the service.
Compliance
with All Laws:
Any violation of any laws of the United States, Commonwealth of Pennsylvania, or
any other laws that SkyeNet deems applicable is immediate violation and can
result in termination of account. All customers will "hold the ISP harmless" in
any claim against same.
Unacceptable Conduct:
SkyeNet holds the following items, though not limited to, violations of conduct
and may result in termination of your account or other repercussions.
1. Excessive posting or otherwise abusing USENET
2. Sending unsolicited emails (spam); Using SkyeNet to do anything with spam.
3 Harassing other individuals, mail bombing, impersonating or falsifying any
information, violating anyone's privacy, use of IRC bots network-unfriendly
activity or hacking that causes interference with normal network operations.
4. Attempts to gain unauthorized access to the SkyeNet's servers.
5. Participating in chain letters any other attempt to use your ISP as a staging
ground to hurt others in any way.
6. Any activity deemed immoral or by our discretion a harmful act.
Right to
Disconnect Non-dedicated Accounts:
We may temporarily disconnect idle or overused connections. This is usually
temporary and simply requires a quick re-connect (use of the service again).
Excess
Utilization of System or Network Resources:
SkyeNet
may disconnect/terminate accounts, or take restrictive action against a
connection that is/may impact the network performance of the majority and/or
other users. We reserve the right to determine over-usage and usually amount to
4 times the amount of an average user or such excessive use that it impacts the
networks of SkyeNet.
Compliance
with Rules of Other Networks:
We will investigate and act on all reports of spam or any type of damage reports
of other ISPs. This could lead to immediate disconnection/termination of your
account and also possible legal action.
ISP's
Right to Suspend or Cancel Accounts:
SkyeNet reserve the right to terminate accounts for any reason. We do not have to
provide service to anyone or any business. Disrespect towards our employees or
any other type of action will result in termination and no refunds. Our policy
on this is very strict with no tolerance.
Non-Payment:
All accounts that are terminated for non-payment will be charged a $10
re-connection fee if it is within the first 10 days. After that, the account is
considered closed and a $50 connection fee applies.
All
customers must inform SkyeNet immediately of phone number changes, address changes,
or any changes in personal information. Any refunds will be refunded at the
monthly rate. For example, if you receive a discount for a 1 year term that
discount no longer applies and you would be refunded the prorated non-discounted
amount minus the disconnect and other fees.
Rights to
Damages:
SkyeNet maintains the right to claim economic damages from you or your business
if you or anyone using your connection violates this AUP and causes SkyeNet any
economic harm.
Right to
Modify or Change Service:
SkyeNet has the right to update and change this AUP as need or see fit. If any
customer ever disagrees with this AUP, then their sole recourse is to cancel
service with SkyeNet immediately.
You may
check the website http://SkyeNet.biz/AUP for any changes every 30 days.
By using
any SkyeNet services or affiliated services you agree to this AUP. As mentioned
above, you have 5 days to disagree and terminate services with refund (except on
signed contract services or signature on this document) by writing or calling to
terminate.
You have
agreed to these terms unless you have written to SkyeNet within 5 days of
service and also have terminated the account. Visiting any website of SkyeNet,
or any of its hosted sites, also constitutes acceptance as this is AUP which is
widely available.
